These Terms and Conditions of Use (“Terms”) apply to the digital card used to pay for purchases at participating venues, when you claim your earnings in the BrandPay App (“BrandPay Card”). The BrandPay Card does not hold any stored value and is not a credit product.
The BrandPay Card is issued by Vault Payment Solutions Group Pty Ltd (ABN 66 632 373 105) (“Vault”) pursuant to an intermediary authorisation between Vault and Flexewallet Pty Ltd (ABN 16 164 657 032) AFSL 448066. In these terms and Conditions, “we”, “us” or “our” means Vault; and “you”, “your” or “user” means the cardholder of a BrandPay Card.
If you acquire the BrandPay Card, you will have a contract with us.
- When we refer to a “Digital Wallet”, we are referring to Apple Pay or Google Pay or any other digital wallet provider capable of provisioning the BrandPay Card to your Device;
- When we refer to a “Device” we are referring to a mobile or wearable device that allows you to store or otherwise add a BrandPay Card to a Digital Wallet;
- When we refer to a “Backup Card” we are referring to an eligible credit or debit card provided within the BrandPay app that is used to fund transactions in excess of the balance of the BrandPay Card.
1. Accepting the BrandPay Card and agreeing to these Terms
You agree to be bound by these Terms by using the BrandPay Card in any capacity including, but not limited to, provisioning the BrandPay Card onto your Device, using any BrandPay Card features or completing a transaction with the BrandPay Card.
Use and access to the BrandPay Card is subject to your respective Device capability. This means your Device must have the ability to store the BrandPay Card and make a purchase using a Digital Wallet.
You must first download and install the BrandPay App (subject to separate terms and conditions of True Ample Limited (Hong Kong Co. No. 3065248) trading as BrandPay (“BrandPay”) and you may nominate an eligible credit or debit card within The BrandPay App as the additional funding source for transactions made using the BrandPay Card that are more than the balance on the BrandPay Card – refer to the BrandPay terms and conditions.
2. How and where you can use the BrandPay Card
When you present the BrandPay Card to make payment at a participating merchant, the BrandPay Card will be debited by the monetary amount of your purchase.
If you have added a Backup Card and the total transaction value exceeds the balance on your BrandPay Card, BrandPay may approve the transaction using your Backup Card to cover the shortfall. Any amount funded by your Backup Card will be charged to your Backup Card separately from the transaction at the merchant. You are responsible for ensuring there are sufficient funds available on your Backup Card to cover any such charges.
If you have not added a Backup Card and the total transaction value exceeds the balance on your BrandPay Card, the transaction will be declined. You will need to complete the purchase using an alternative payment method.
Attempts to use the BrandPay Card at merchants that are not otherwise approved to accept the BrandPay Card will result in a declined transaction.
The BrandPay Card does not have cash out capability, cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular installment payments.
3. Checking your BrandPay Card transaction history
BrandPay transaction activity information can be found by accessing the BrandPay app. You are responsible for checking the transaction history of the BrandPay Card. You acknowledge and agree that we do not provide you with account statements.
You will also be responsible for checking the transaction history of the Backup Card (through the provider of your Backup Card) to ensure the accuracy of all transactions made using the BrandPay Card.
4. Validity and Expiry of The BrandPay Card
The BrandPay Card is valid for three years. After its expiry or cancellation, the BrandPay Card will be declined when presented for use.
5. Your BrandPay Card, your responsibility
You are responsible for all transactions on the BrandPay Card, except where there has been fraud or negligence by our staff or agents. If you permit someone else to use the BrandPay Card, you will be responsible for any transactions initiated by that person with the BrandPay Card.
If you notice any error relating to the BrandPay Card, you must notify BrandPay Customer Support immediately via the BrandPay App or alternatively, via email to [email protected]
Except to the extent required by law, we are not liable for any loss or damage arising out of or in any way related to the use of the BrandPay Cards, including:
- If authorisation is declined for any transaction, except where the authorisation has been declined because of an act or omission on our part;
- The availability of merchants who allow the use of the BrandPay Card as payment;
- Reduced levels of service caused by the failure of third-party communications and network providers or any outage.
Unauthorised transactions can happen using the BrandPay Card if the Device is lost or stolen, a personal identification number is revealed to any other person, or because of fraud.
6. Fees and Charges
Refer to the terms of use for any fees applicable to the use of your BrandPay Card. To the extent permitted by law, some merchants may surcharge you for using the BrandPay Card with their point of sale terminal and such fees may be deducted from the balance of your BrandPay Card at the time of the transaction.
7. Refunds or exchanges
Any refunds on BrandPay Card transactions are subject to the policy of the participating merchant. If the BrandPay Card expires before you seek a refund from a participating merchant, then those may not be returned to your Backup Card.
Once a transaction has been completed using your BrandPay Card, you cannot “stop payment” on that transaction. If you have a problem with a purchase made with the BrandPay Card, or a dispute with a participating merchant, you must first deal directly with the merchant involved. If you cannot resolve the dispute with the merchant, you can contact BrandPay Customer Support.
8. SMS and Email Correspondence
BrandPay will communicate with you by sending a One Time Passcode (OTP) via SMS or email at the point of card tokenisation into the Digital Wallet. This communication will be sent to the details you provide at card registration.
9. Privacy
Information will be disclosed to third parties about the BrandPay
Card, or transactions made with the BrandPay Card, whenever allowed by
law, and where necessary to operate the BrandPay Card and process

10. Changes to these Terms
We reserve the right to change these Terms at any time. Any changes to the Terms can be viewed within the BrandPay app.
